In a major development in the antipodes, Radio New Zealand reports that the country's ban on puberty blockers has been overturned at the high court.
The government’s ban on new puberty blocker prescriptions for young people with gender dysphoria was unlawful in a decision released on Wednesday. Justices ruled that the ban had unfairly discriminated against young trans people, had not been implemented with any consultation with trans people or their organisations, and had been a egregious breach of the country's Bill of Rights.
Radio New Zealand reported that the judgment found that the ban treated young people seeking puberty blockers for gender-related healthcare differently from those accessing the medication for other conditions, putting them at a material disadvantage. It also concluded that a complete prohibition on new prescriptions was a disproportionate response, despite recognising a rationale for some restrictions. The case against the government is a victory for the transgender movement and especially for The Professional Association for Transgender Health Aotearoa (PATHA).
When we look at the background to usually liberal New Zealand's initial ban on puberty blockers, one name kept coming up from the government side - that of the discredited Hilary Cass, the author of the United Kingdom report which has been slammed by professional organisations and medical practitioners for being ideologically motivated by extreme forms of feminist known as TERF (Trans Exclusive Radical Feminism). The Cass review has been behind much of the anti-transgender furore in the UK.
