Data Protection Complaints Procedure

ShoutOut LGBT+ Radio is committed to protecting your personal data and respecting your privacy rights under UK data protection law, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

This procedure explains how to make a complaint about how we handle your personal data, and how we will respond.

What this procedure covers

You can use this procedure if you believe we have:

Processed your personal data unlawfully or unfairly
Failed to respond properly to a data subject request (e.g. access, rectification, erasure)
Shared your data without a valid lawful basis
Kept your data for longer than necessary
Failed to protect your data adequately
Used your data in a way you did not consent to

How to make a complaint

If you prefer to write, please request our postal address by email and we will provide it.

Please include in your complaint:

Your full name and contact details (so we can respond)
A clear description of your concern, including dates if known
What personal data is involved, if you know
What you would like us to do to resolve the issue

What happens next

Acknowledgment (within 5 working days)
We will confirm we have received your complaint and provide a reference number.
Investigation (within 30 calendar days)
We will investigate your complaint. This may involve reviewing our records, speaking with relevant team members, and examining how your data was collected, stored, used, or shared. We may contact you if we need further information.
Response
We will provide a full written response explaining our findings, whether we uphold your complaint, and what action we will take. Actions may include correcting or deleting your data, restricting processing, updating our procedures, or providing further explanation.
Extension (if needed)
If the investigation is complex or we are waiting on further information from you, we may extend the timeframe to up to 60 calendar days. We will notify you if this happens.

Resolution

If we uphold your complaint, we will take appropriate action and confirm what we have done. If we do not uphold your complaint, we will explain our reasoning and provide evidence where possible.

Right to escalate to the ICO

If you are not satisfied with our response, or if we do not respond within the timeframes above, you have the right to refer your complaint to the Information Commissioner's Office (ICO), the UK's independent data protection regulator.

What we may ask you for

To help us investigate your complaint effectively, we may need to verify your identity and ask for additional information. We will only ask for what is reasonably necessary and proportionate to the investigation.

No detriment

Making a data protection complaint will not affect your relationship with ShoutOut LGBT+ Radio in any way. You will not be treated unfavourably for exercising your data protection rights.
